Terms of Service

These Terms of Service govern your use of the SWIFT BOULDER LLC website and our residential heating, cooling, indoor-air-quality, maintenance, repair, installation, estimate, and related services. By using the website, requesting service, approving an estimate, scheduling work, or purchasing a plan or service, you agree to these terms.

Who may use the website and services

The website is for people who can lawfully request residential services or act for a property owner or organization.

You must be at least 18 years old, or the age of majority where you live, to approve paid work, sign service documents, or enter payment obligations. If you request service for a property you do not own, you represent that you have authority to request access, approve work, and provide information about that property.

Services we provide

We repair, install, maintain, and quote residential comfort systems. The website describes services generally, not a guarantee that every service is available for every home.

Services may include heating, cooling, heat pumps, furnaces, boilers, ductless systems, thermostats, filtration, humidity, ventilation, tune-ups, diagnostics, estimates, emergency response, maintenance plans, parts, equipment, and related work. Service availability depends on location, scheduling capacity, technician assessment, parts availability, safety, weather, building conditions, and applicable law.

Estimates, pricing, and approvals

We aim to quote clearly. If conditions change, we stop and get approval before adding paid work.

Website pricing, plan descriptions, starting prices, and promotional text are general information and may change. Final pricing depends on the equipment, diagnosis, site conditions, selected materials, permit needs, code requirements, and approved scope.

An estimate becomes binding only when we issue it in writing and you approve it. If hidden conditions, unsafe conditions, code issues, inaccessible equipment, additional parts, or scope changes are discovered, we may revise the estimate. We will seek your approval before performing additional paid work unless immediate action is required for safety or legal compliance.

Payment terms

Payment is due as stated on the approved estimate, invoice, plan terms, or written agreement.

Unless we agree otherwise in writing, payment is due when service is completed, equipment is delivered or installed, a maintenance plan begins, or an invoice becomes due. We may require a deposit for equipment, special-order parts, large jobs, or scheduled installations.

Prices are stated in U.S. dollars unless otherwise shown. You are responsible for applicable taxes, permit fees, special-order charges, late fees, returned-payment fees, collection costs, and other charges described in the approved documents.

Cancellations, refunds, returns, and fulfillment

Detailed customer policies are published separately so they are easy to find.

Our Refund, Returns, and Cancellation Policy and Service Delivery Policy are incorporated into these Terms. They describe appointment changes, deposits, maintenance plans, installed equipment, special-order items, refunds, and service fulfillment timing.

Customer responsibilities

Safe access and accurate information help us complete the job correctly.

  • Provide accurate contact, service address, equipment, access, billing, and scheduling information.
  • Make sure an adult is present when required and authorized to approve work.
  • Provide safe, reasonable access to equipment, electrical panels, attics, crawl spaces, roofs, yards, and work areas.
  • Secure pets, valuables, personal items, and fragile materials near the work area.
  • Disclose known hazards, prior work, water damage, electrical issues, asbestos concerns, structural issues, or access limitations.
  • Obtain HOA, landlord, tenant, or property-management approvals when required.

Workmanship, manufacturer warranties, and exclusions

We stand behind our labor, while equipment and parts are usually covered by manufacturer terms.

We warrant that our labor will be performed in a professional manner consistent with applicable trade standards. If an issue is caused by our workmanship, notify us promptly and give us a reasonable opportunity to inspect and correct it.

Equipment and parts may be covered by manufacturer warranties. Those warranties are provided by the manufacturer, not by us, although we may help with registration or claims when available.

  • Warranty coverage does not apply to misuse, lack of maintenance, altered equipment, work performed by others, pre-existing conditions, owner-supplied parts, power issues, weather damage, water intrusion, pest damage, code violations created by prior work, or normal wear.
  • Maintenance plans, tune-ups, diagnostics, and repairs do not guarantee that older equipment will not fail later.

Website use and prohibited conduct

Use the website lawfully and do not interfere with it.

  • Do not submit false, misleading, fraudulent, abusive, unlawful, or infringing content.
  • Do not attempt unauthorized access, scraping, reverse engineering, security testing, spam, malware, or interference with the website.
  • Do not use the website or our services for illegal, deceptive, exploitative, or harmful activity.
  • Do not copy, reuse, or misrepresent our branding, website content, photos, logo, or materials without permission.

Privacy and communications

By submitting a service request, calling us, or communicating with us, you authorize us to contact you about your request, appointments, estimates, invoices, maintenance plans, warranties, and related services. We may use third-party providers for payment processing, communications, scheduling, warranties, website hosting, and business operations. Those providers may have their own terms and privacy policies.

Disputes and governing law

If a dispute arises, you agree to contact us with a written description of the issue and allow a reasonable opportunity to inspect, respond, and attempt to resolve it. These Terms are governed by the laws of Wyoming, without regard to conflict-of-law rules. Courts located in Wyoming will have jurisdiction unless applicable law requires another forum.

Changes to these terms

We may update these Terms as the business, website, or law changes.

The updated Terms will be posted on this page with a new last updated date. Changes apply prospectively unless otherwise required by law or agreed in writing. Continued use of the website or later service requests after changes are posted means you accept the updated Terms.

General provisions

These Terms, together with approved estimates, invoices, maintenance plan documents, and linked policy pages, form the agreement between you and SWIFT BOULDER LLC for the website and covered services. If one part is unenforceable, the rest remains in effect. A delay in enforcing a right is not a waiver. You may not assign your rights or obligations without our written consent; we may assign them as part of a merger, sale, reorganization, or transfer of business assets.
